Terms & Conditions

These Terms set out the agreement between you and OCC Academy of Education when you register for a course or programme.

Document status This is the publicly available text of our Terms & Conditions. The English version is the operative version. Translations into Dutch and Spanish are provided for convenience; in the event of any inconsistency, the English text governs.

1. The parties

"OCC Academy of Education" (also "the Academy", "we", "us", "our") is a brand of OCC Holding and Consultancy, with offices at Wayaca 6B, Aeromall, Hyatt Place Aruba Airport, Oranjestad, Aruba.

"You" or "the participant" means the individual or organisation that registers for a course or programme with us.

2. Registration and enrolment

You register by submitting the registration form on our website, by email, or in person at our offices. Submission of a registration form is an expression of interest. Your place is confirmed only when we acknowledge your registration in writing and we have received your payment in full (or the first installment of an agreed payment plan).

If a course is full at the time of your registration, we will inform you and place you on a waiting list for the next available cohort or offer you private instruction by arrangement.

3. Payment

Tuition is due in full before the course begins, unless we have agreed a payment plan with you in writing. Payment details will be shared with you after your registration is acknowledged.

All amounts are stated in Aruban florin (Afl.) or US dollars (USD) as indicated. Where bank transfer is used, all bank fees are borne by the participant.

4. Non-refundable tuition, with a credit for one year

This is the most important clause of these Terms. Please read it carefully.

Tuition is non-refundable. Once paid, course fees cannot be returned in cash or by bank transfer.

However, we understand that life happens. If you need to discontinue a course for any reason — illness, work, family, relocation, or personal circumstance — your tuition becomes a credit valid for twelve (12) months from the original course start date. You may apply this credit to:

Credit balances are not transferable to a third party and cannot be exchanged for cash. After twelve months, any unused credit expires.

5. Attendance

Attendance is your responsibility. Missed classes are not generally rescheduled. If you anticipate an extended absence, contact us in advance so we can advise on the best path forward.

For private instruction, individual cancellation policies apply and are agreed at the time of arrangement.

6. Cancellation by OCC Academy

We reserve the right to cancel or postpone a course or cohort, in particular when:

If we cancel a course before it has begun, you may choose either a full credit toward a future course or, exceptionally, a refund of the unused portion.

7. Photo, video, and student work

By registering, you consent to OCC Academy taking photographs and short video recordings of classroom activity, ceremonies, and events, and to our use of such material on our website, social media, and other communications.

If you do not wish to be photographed or recorded, you must notify us in writing before your course begins at info@occacademyaruba.com. We will make reasonable efforts to honour your request, including by seating you outside the frame of any photography or by excluding your image during editing.

Where a course assignment or piece of student work is reproduced, we will obtain your separate written consent and credit you by name unless you prefer to remain anonymous.

8. Course materials and intellectual property

All course materials provided by OCC Academy — textbooks, workbooks, audio files, digital resources, and assessments — remain the intellectual property of OCC Academy or its licensors. Materials are provided for your personal study only. You may not copy, redistribute, resell, or share them with non-enrolled parties without our written permission.

9. Certificates and assessments

Certificates of completion are issued only upon successful fulfilment of attendance and assessment requirements as set out at the start of your course.

Where a course indicates a CEFR level (A1 through C1), the certificate states the level the participant has demonstrably reached, which may be the level enrolled for or, in some cases, a lower level if the requirements were not met.

10. Code of conduct

OCC Academy is a learning environment built on respect. We expect every participant, instructor, and visitor to behave with courtesy, regardless of nationality, language, religion, gender, or background.

We reserve the right to dismiss any participant, without refund or credit, for behaviour we determine to be threatening, harassing, dishonest, or seriously disruptive to other learners.

11. Force majeure

If circumstances beyond our reasonable control — including but not limited to pandemic, hurricane, government order, infrastructure failure, or war — make in-person instruction impossible, we may continue the course online or postpone it to a later date. In such cases:

12. Limitation of liability

To the maximum extent permitted by Aruban law, our liability arising from your participation in any course or programme is limited to the amount of tuition you have paid to us for that course or programme. We are not liable for indirect, incidental, or consequential loss, including but not limited to loss of earnings or business opportunity arising from delayed or interrupted instruction.

Our handling of your personal data is described in our Privacy Policy, which forms part of these Terms.

14. Naturalization preparation: a specific note

OCC Academy prepares participants for the Naturalization Test administered by the Government of Aruba. We do not:

We prepare you in Dutch, in Papiamento (through our sister school Cas di Papiamento), and in Aruban society and culture, to a standard that gives you a strong basis to sit the test. The final outcome remains with the authorities and with you.

15. Changes to these Terms

We may update these Terms from time to time. The current version is always available at occacademyaruba.com/terms.html, with the "last updated" date shown below. Material changes will be communicated to active participants by email.

16. Governing law and jurisdiction

These Terms are governed by the laws of Aruba. Any dispute arising under or in connection with these Terms shall be submitted to the competent courts of Oranjestad, Aruba. Dutch is the official language of proceedings.

We always prefer to resolve concerns directly and informally first. Before pursuing any formal action, please contact us at info@occacademyaruba.com so that we may try to resolve the matter with you.
